INDIAN RIVER COUNTY － A significant chapter could close on the county’s legal fight against Virgin Trains USA on Tuesday. The county attorney has recommended commissioners end their appeal of the noteworthy court case against the higher-speed passenger railroad.
The recommendation comes as Indian River County lost its latest appeal last month in the U.S. Court of Appeals. Judges ruled Virgin Trains, formerly Brightline, can legally finance its private railroad project with government issued, tax-free private-activity bonds.
